Estamos en una sociedad en donde la situación de que los padres no se encuentren juntos es el pan de cada día en muchas familias.
Lo ideal sería que la familias no se separaran, pero cuando se dan estas circunstancias hay que reglamentar algunas situaciones, una de ellas es:
La Reglamentación de visitas.
La ley se refiere a este tema ya que es muy importante entender que es un deber y un derecho de los padres de poder participar en la vida y crianza de sus hijos.
Al llevar estos casos a los juzgados debemos comprender que el Juez o Jueza que sea asignada al proceso de Reglamentación no va evitar que uno de los padres vea a los hijos, ya que como dijimos es un
derecho de los padres.
Lo que buscara el Juez o la Jueza será procurar el interés superior del menor.
Y es importante recalcar que a menos que se pueda probar que uno de los padres puede colocar al hijo o hija en peligro, entonces se aplicarían medidas de protección para buscar la seguridad de los niños o niñas.
Explicado esto, debo decir que he evitado mencionar al Padre o Madre, ya que la ley tendrá en igualdad de condiciones a estos, y procurará que los hijos queden en cuidado del progenitor en cuya compañía se encontraban al momento de producirse el desacuerdo.
Que pasa en la audiencia ?
En el proceso de Reglamentación, antes del acto de audiencia se buscara que las partes concilien, ósea que lleguen a un acuerdo. Siempre es mejor llegar a un acuerdo, ya que no se siente que es algo impuesto.
Existe mayor probabilidad de que se cumpla con lo pactado que cuando es impuesto por un tercero.
